Anonymization: A process by which data relating to the data subject cannot be identified, taking into account the use of reasonable technical means available at the time of processing.

National Data Protection Authority (“ANPD”): A government body responsible for overseeing compliance with the provisions of the LGPD throughout Brazil.

Employee All SCANNTECH employees, regardless of the position or title held.

Clients: entity or organization (individual or legal entity) that contracts and uses the services and/or products offered by SCANNTECH to meet their specific needs.

Controller: An agent who is responsible for making decisions relating to the Processing, such as the form, duration, means and purpose of the activity. Consent: Free, informed and unequivocal expression of the data subject authorizing the Processing of their Personal Data for a specific purpose.

Personal Data: Any information relating to an identified or identifiable natural person. An identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as name, ID, tax ID number, email address, telephone number, home/business address, financial data, other location data, electronic identifiers or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that person.

Sensitive Personal Data: Any Personal Data concerning racial or ethnic origin, religious conviction, political opinion, trade union membership or membership of a religious, philosophical or political organization, as well as data concerning health or sex life, genetic or biometric data.

Data Protection Officer (“DPO”): A person appointed by SCANNTECH to be responsible for ensuring service to data subjects and clarifying doubts about the Processing of Personal Data.

LGPD: Brazilian General Data Protection Law (Federal Law No. 13,709/2018).

Platform: SCANNTECH’s official website and Apps and other partner digital platforms.

Third Party: Refers to, but is not limited to, any natural or legal person with whom SCANNTECH relates or will relate, service provider, supplier, consultant, customer, business partner, third party contractor or subcontractor, tenant, assignee of commercial space, whether under formal agreement or not, including those who use the name of the organization for any purpose or who provide services, supply materials, interact with public officials, the government or other third parties on behalf of SCANNTECH.

Owner: Natural person to whom the Personal Data refers, such as clients and employees.

Processing: Any operation carried out using personal data within its life cycle, such as collection, production, reception, classification, use, access, playback, streaming, distribution, processing, archiving, storage, deletion, evaluation, or control of information, modification, communication, transfer, dissemination, or extraction.

Shared Use of Personal Data (or Sharing): Any sending, communication, dissemination, international transfer, interconnection of Personal Data between SCANNTECH and third parties and/or companies of the same group, not being considered a sharing of Personal Data the sending of Data between areas of the same company.

Sensitive Personal Data: data related to your racial/ethnic origin, health, or sex life.

Features associated with your electronic devices: IP address, approximate geographical location of the device, type of device, operating system, browser and version, preferred language, pages visited, browsing behavior, reference data,
length of stay, among other cookies stored by third parties.

HOW LONG DO WE STORE YOUR PERSONAL DATA? We store your Personal Data for as long as necessary to achieve the purposes for which it was collected. Where possible, we will keep Personal Data in an anonymized form, respecting the highest level of care and market security.
WHO DO WE SHARE YOUR DATA WITH? We may share your Personal Data with third parties located in Brazil or internationally (such as other subsidiaries of the SCANNTECH Group, our partners, and suppliers) in order to achieve the purposes for which they were collected.

In addition, we may share certain information about you when necessary to comply with requests from legal authorities, as well as to comply with legal or regulatory obligations applicable to SCANNTECH.

GOVERNING LAW This notice has been prepared for special compliance with Legislation No. 13,709/2018 (“General Data Protection Law” – “LGPD”); No. 12,965/2014 (” Brazilian Civil Rights Framework for the Internet” – “Marco Civil da Internet”); and No. 8,078/1990 (“Consumer Protection Code – CDC”), without prejudice to compliance with other legislation applicable to the activities provided by SCANNTECH.

HOW DO WE COLLECT YOUR PERSONAL DATA?

The information we process about you may have been provided directly by you to SCANNTECH, by Third Parties or even collected automatically through our Platform and other channels.

Let’s take a closer look at each of these data collection situations.

a: Information provided directly by you

From the start of your interaction with us, you voluntarily provide us with information about yourself. For example, when you contact us through our service channels, such as when you fill in forms available on our website, call our contact telephone number or talk to us through messaging applications (such as WhatsApp). In addition, we may collect information from you when you send us an email, as well as when you interact with content on our Platform or other tools.

b: Information obtained from third parties

In specific cases, we may also receive some of your Personal Data through Third Parties. For example, when you represent one of SCANNTECH’s contractors (such as consultants, employees or service providers of business partners and suppliers).

Occasionally, we may also receive information from you when you contract services with us in the identification stages, in which case we will use third-party systems. 

In addition, we may advertise our vacancies on specialized websites, we also receive CVs through our website, from referrals from our Employees, as well as any CVs left in person at our physical units. In these cases, SCANNTECH may receive information about CVs, according to the candidates’ own interest in our job opportunities.

c: Information obtained automatically

In some situations, we may also collect Personal Data automatically through the devices you use to access our Platform. This information helps us to generate access statistics and thus get to know our audience better. This is important so that we can improve our Platforms and services, as well as tailor them to the most diverse audiences (for example, to create educational communication and technical support actions to improve our users’ experience). Some of this data may be collected through cookies or similar technologies, as we will explain in a separate section below.

We may also collect information from you that is publicly available on social networks (such as LinkedIn) and in public databases (such as the Internal Revenue Service Portal).

In order to respect your privacy, we understand that any processing of your Personal Data must be limited to the minimum necessary, in a pertinent and proportional manner, to achieve the intended purpose.

For this reason, the Personal Data we collect about you will vary depending on the relationship you choose to have with us, i.e. as a customer, consumer, visitor, partner, etc.

The following are the main types of Personal Data that we may process, grouped into categories:

⦁ Registration data: full name, email address, username (application used by our Retail Customers), ID, tax ID number, zip code, corporate tax ID number (when Individual Microentrepreneur – MEI), home address, city, state, date of birth, image/photo/scan, passport and signature.

⦁ Contact details: landline or cell phone and personal/professional email.

⦁ Professional data: company/entity/organization you represent, department and professional email;

⦁ Financial data: salary, payment history and bank details (bank, account and credit card details);

⦁ Qualification data: nationality, marital status, age, gender, affiliation, education, school/academic history, languages, profession, qualifications and certifications, salary and salary claim, skills test result, as well as other information provided in a CV;

Behavioral data: browsing history and use of our Platforms (such as frequency of access, geolocation, browsing time, “Time Stamp” – record of date and time of Use, etc.), as well as information inferred from profiles on social networks (such as LinkedIn);

⦁ Sensitive Personal Data: data related to your racial/ethnic origin, health (disability), sex life and facial biometrics;

⦁ Features associated with your electronic devices: IP address, approximate geographical location of the device, type of device (computer, smartphone, tablet, etc.), operating system (Windows, macOS, iOS, Android, etc.), browser and version (such as Chrome, Firefox, Safari, Edge), preferred language, pages visited, browsing behavior on the Platform (clicks, movements and user interactions), reference data (for example, from a search engine or another website provided by a Third Party), length of stay, among others.

⦁ to make a selection of the profiles we consider most suitable for the positions applied for;

⦁ to contact interested candidates and to facilitate all stages of our selection process (including tests, assessments, and interviews).

⦁ we may process your Personal Data to ensure your security (and that of Third Parties) and to prevent identification fraud, particularly during your access to our Platforms or our physical spaces.

 

⦁ WHO DO WE SHARE YOUR PERSONAL DATA WITH?

SCANNTECH may share your Personal Data, in which case it will be restricted to the minimum appropriate and necessary for the fulfillment of any of the specific purposes previously informed to you in this Notice.

 Thus, we may share your data with third parties in the following situations:

 ⦁ with subsidiaries of the same SCANNTECH group located abroad (such as in Uruguay, Argentina and Peru), to support our internal operations and commercial transactions with our Clients;

⦁ with tools, applications and systems to carry out analysis on the daily operation of our processes and business, and thus enable the constant improvement of our products and/or services;

⦁ with business partners and suppliers necessary for the execution, dissemination and promotion of our business activities;

⦁ with business partners and service providers, to allow for communication and marketing channels to operate, as well as providing the necessary structure to make our services viable (such as cloud storage systems);

⦁ with platforms specialized in the recruitment and selection process, used to facilitate and optimize the process of hiring new employees for SCANNTECH;

⦁ in the event of a corporate transaction, such as mergers, acquisitions, spin-offs and takeovers;

⦁ with administrative and legal authorities when necessary to comply with a legal obligation or to assist in the investigation of suspicious or illegal activities; and

⦁ with law firms, legal counsel, and other legal representatives, when necessary to defend SCANNTECH’s interests in administrative, arbitration or legal proceedings.

 In order to safeguard the protection of your Personal Data when we carry out the sharing referred to in the above situations, SCANNTECH uses contractual instruments to ensure that any Third Party receiving them guarantees them adequate protection.

 In situations where the sharing is with a Third Party located outside Brazil, in addition to safeguarding the security and protection of Personal Data by means of a contract, SCANNTECH makes use of one of the legal hypotheses of international transfer authorized by law.

 ⦁ HOW LONG DO WE STORE YOUR PERSONAL DATA?

 We will not keep your Personal Data for longer than necessary for the purposes stated above, nor will we use your data for other purposes, except in the cases authorized by law

 Whatever relationship you choose to establish with SCANNTECH, you are guaranteed all the rights relating to your Personal Data provided for by law, including:

⦁ knowing which of your Personal Data we process;

⦁ correcting incomplete, inaccurate or outdated data;

⦁ requesting the anonymization, blocking or deletion of data that is unnecessary, excessive or that may have been processed in breach of the law;

⦁ requesting data portability to another service or product provider;

⦁ ordering a review of solely automated decisions that affect your interests;

⦁ request at your consent the deletion of processed data;

⦁ obtaining information about the public or private entities with which we share your data; and

⦁ when the Processing activity requires your consent, you may refuse to consent. In this case, we will inform you of the consequences of not carrying out this activity. If you do, you can withdraw your consent at any time.

 You can exercise your rights at any time. To exercise them, you can contact our Data Protection Officer at dpo@scanntech.com. To do so, we ask that you identify yourself and specify which right you wish to exercise.

 Other information and/or documents may be requested by SCANNTECH in order to confirm your identity or the accuracy of your data.

 Requests involving the Personal Data and/or documents of other data subjects will not be complied with, except by means of a power of attorney, parental authority or other circumstance that authorizes the exercise of another data subject’s right on your behalf.

 Please note that, in specific circumstances, your request may not be fulfilled. In these cases, we will explain the reasons for not doing so.
